General: Royalty Free Stock images are for use by one entity and are not to be resold or shared, but may be reused as often as desired by the one entity. Of course, your clients may reuse your artwork, but this artwork may not be altered or reused by another artist or graphic designer without the new artist/designer obtaining a new license. A graphic designer's client may purchase a license for use by several graphic designers working on the client's own projects, but these images may not be used for projects for any other clients of these designers. Gold Star images are not royalty free and are rights managed, licensed for a one-time specified use. Click here for an agreement form in PDF format. Many scans from film are available in a higher resolution than that listed. These higher resolution images are available under the Gold Star Rights Managed policy and cost an additional amount. These images may not be copied, distributed, altered, or used in any manner not spelled out here without purchasing a license or obtaining written permission from Kenneth A. Larson. Altering an image does not free you from copyright infringement liability, as you are still using images generated by others. If you are designing a project you may use the images on this site to fill-in for layout purposes, but you may not publish these images without obtaining permission or a license. This includes, but is not limited to, free sites, personal sites, and not-for-profit sites. Personal use: I offer a 50% discount for images for non-commercial personal use such as personal web sites. Stock Photography: Stock photography is existing images which the user would purchase the rights to use rather than assigning photographers to shoot. The main benefits of stock photography are that you see the final image before you license the rights to use them and these images can be licensed immediately. The cost for stock photography images are much lower compared to assignment photography. Stock photography saves you the cost of model, photographer, location, props, art direction and editing cost. Royalty Free: Royalty Free Stock Photography is where the user of the images does not have to pay any royalty for repeated use of the images. The buyer does not own the copyright of the images but has bought the right to repeatedly use the images legally without further payments or interruption from the seller. These images cannot be resold or transferred, but it offers a wide range of benefits; mainly lower pricing and convenience. Rights Managed: Rights Managed offers individual images to be used through the negotiation of a specific price for a specific use. For various reasons, the photographer does not allow some images or higher resolution versions of some images to be royalty free and tries to limit their use. Use of comping / preview images for final artwork: The low-resolution images in this site may be used for comps and layouts. The low-resolution images may not be used in any final materials distributed inside a company or any materials distributed outside a company or to the public, including, but not limited to, advertising and marketing materials or any online or other electronic distribution system. You may present comps to your clients for their review. These images may not be distributed, sublicensed or made available for use or distribution as groups or individually, and no rights are granted to the low-resolution images. Copyright: All images on this site are copyrighted by virtue of creation. A copyright is the exclusive right granted to authors under the U.S. Copyright Act of 1976 to copy, adapt, distribute, publicly perform, and publicly display their works of authorship, such as literary works, databases, musical works, sound recordings, photographs, and other still images, and motion picture and audiovisual works. All images on this site are copyrighted by Kenneth A. Larson. User Licensing Agreement: This agreement is between you, the buyer, and Kenneth A. Larson, the seller. Use of the photography from this web site and/or by Kenneth A. Larson constitutes your acceptance of the terms of this agreement. User Rights: With payment of the price due for the photographs purchased, the buyer has obtained non-exclusive, non-transferable right to use the photograph as described in this agreement. Kenneth A. Larson retains all rights. The buyer may not transfer usage rights to any third party. The buyer may use the photograph for his/her own projects as well as for his/her clients projects in accordance with the terms of this agreement. The photograph(s) may be used for promotional materials, magazines, brochures, posters, publications, product packaging, billboards, video clips, multimedia productions, TV commercials, and web site illustrations. The photos may be manipulated through cutting, cropping, scaling, color changes, etc. However, use of the image (or any part of an image) in any pornographic, sexual, negative, cruel, violent, abusive, libelous, or defamatory content is strictly prohibited. Model and Object Releases: The photographer, Kenneth A. Larson, is most interested in architecture and scenery. In most cases, he attempts to minimize people in his photographs. Sometimes it is unavoidable and people do appear in these photographs. In these cases, identities of these people are not known and releases can not be obtained. The photographer does make every effort to minimize any identifiable features of these people by showing people from the back, from a distance, or hiding the faces behind foreground objects. When Kenneth A. Larson photography does involve small groups of people (6 people or less) in staged photographs, these photos will include a model release and will say "Model release" in the information for that image. Do not assume a model release has been obtained for an image. If your use requires a model release and the image does not read "Model release," we can not obtain a model release. For shots such as crowds, street scenes, or similar photographs, due to the nature of such photographs, model releases cannot be provided. The purchaser is advised that Kenneth A. Larson will not be liable in any form, for any claims brought forward by people depicted in crowds, street scenes. or similar photographs. For photographs depicting logos, trademarks, brand names, or buildings, object or property releases are not available. The buyer is advised to contact the owner of the logo, trademark, brand name, or building directly to obtain a release if such a release is required. Kenneth A. Larson does try to minimize including names, signs, and trademarks in his photographs. Ken will sometimes digitally obscure parts of signs and license plates. When this occurs, a "(DA)" (Digitally Altered) will be included in the image information below image in the web site. Kenneth A. Larson has images from his previous career building Visual Effects Models. These images are generally not offered for sale. On a limited basis, these images can be made available. The buyer must first obtain permission from the studio, producer, or whichever entity owns the rights to the film or television project or its licensing, for Kenneth A. Larsosn to sell the iamges. Kenneth A. Larson is expressly excempt from liability on these images. These images are under the Gold Star one-time use policy. Privacy Statements, Personally Identifiable Information: The only Personally Identifiable Information (PII) that K. L. Images collects is information that you voluntarily supply when registering for image purchase. Other information that is automatically transmitted by your browser, includes the URL of the Web page you were just on (known as the "Refer"), the IP (or Internet Protocol) address of the computer you are using, or the browser version you are using to access our site is considered anonymous. Credit card transactions are serviced by reputable third party credit card processors. K. L. Images does not keep your credit card information and in fact, never knows your account information. We only retain information on items ordered, name and contact information, and shipping/internet delivery. We will send registrants of K. L. Images email communications on information we think they will find useful, including information about new products and services. It is our policy to never send messages to members who have not asked to be included. In every email, we will remind you of your option to opt out of future email communications. No information about you will be sold to outside parties or used in any unethical manner. We hate spam as much as you do. Photo Credits: I request photo credit whenever possible. I realize credit is not always realistic, but in many cases, such as book covers, book and magazine illustration, posters, cards, and similar applications, credit should not be a problem. |
